1.Customer
Obligation |
|
By submitting your order to Spec2vision, you undertake: |
| That you are aged over 16 years old. |
| That you are not registered blind or registered partially
sighted. |
| That you are not ordering on behalf of another
person. |
| That you are in possession of a written prescription for your
spectacles, and that such prescription has been obtained from a registered
medical practitioner or registered optometrist ("your optician") following the
testing of sight by him/her within the last 24 months if you are under 70 years
old, or within the last 12 if you are aged 70 or over, and that any recommended
retest date has not elapsed. |
| That you will submit all the information written on your
prescription, or a copy of the original prescription when requested. |
| That you will disclose any problems you suffered if you wore
spectacles earlier. |
| That the goods purchased by you would be for individual use
and not for resale. |
| That you agree to provide any details reasonably requested by
Spec2vision to confirm that you are legally able to purchase prescription
glasses. |
| That you agree to make purchases on the Spec2vision website
using your correct name, address, date of birth and any other details
requested. |
| That you are the authorised holder of any credit/debit card
you may use on the Site. |

2. Order Of Goods |
| Order must be placed via the website or via the
E-mail. |
| Your submission of the Order, whether submitted via the Site,
or by mail represents an offer to purchase the Goods from Spec2vision.
Spec2vision may confirm receipt of this offer via email. Any confirmation of
receipt of the Order will not constitute an acceptance by Spec2vision of your
Order. |
| There will be no binding contract between you and Spec2vision
for the supply of Goods until Spec2vision has dispatched the Goods to
you. |
| You may change your Order at any time by contacting
Spec2vision by email until we dispatch the Goods (This clause is not valid if we
have started processing your order. Even then if you want to change your order,
it will be solely on the discretion of Spec2vision and you may be charged an
additional amount for the same). You must let us know of any changes as soon as
possible, because we process orders very rapidly. |

3. Availability Of
Goods |
| All goods advertised on the site are subject to availability.
Spec2vision only displays those products on the site, which are in stock and
available for sale. However, is for some reason we are not able to
supply the goods then we shall inform you by email or by phone. |
| You will not be charged for the goods we are not able to
supply to you. You will be given a choice to replace your order or get a refund.
However, if we do not receive a response from you, Spec2vision may, at its
absolute discretion, provide replacement Goods of an equivalent quality and/or
specification or cancel the Order and provide a refund. |
| Spec2vision has attempted to display all the goods on the
site as accurately and fairly as possible, taking account of the available
reproduction techniques that apply to website design, graphical and photographic
technology. Whilst we try to ensure that there are no changes to the Goods
supplied, it is possible that there might be some minor variations to the
description and/or specification of the Goods, which arise by virtue of changes
made by the manufacturers of the parts, which form part of the Goods. |

4. Limitation of
Supply |
| By English Law we are not allowed to supply glasses to
under-16 year old wearers nor to registered partially sighted or blind
people. |
|
| a) May discuss your prescription with your optician.
|
| b) May ask you to provide the original prescription.
|
| c)May request you to provide us with the “PD” value. However,
if no response is received from you, Spec2vision has absolute discretion to
either process the order with the average “PD” value or to reject the
order. |
| Spec2vision shall, on the advice of its supervising
opticians, have absolute discretion as to whether or not to accept an order.

5. Pricing |
| All the prices displayed in the website, catalogue or any
sales literature are correct at the time of display or print. We reserve the
right to alter the prices without prior notice. However, once we have accepted
your order we will not change the price of your order. |
| We make every effort to maintain prices but prices may
occasionally move up or down depending upon changes in raw material or other
processing costs. |
| The prices of goods include any Value added tax
payable. |
| Spec2vision makes all the efforts to ensure the accuracy of
the prices, however if there is a mispriced item, we will contact you and give
you the right price and will also give you the choice to accept the correct new
price or to cancel the order. |

6. Delivery |
| Unless stated otherwise in writing: Delivery of the
goods will take place at the delivery address stated on the order
form. |
| Delivery of the goods will take place within twenty-eight
working days. You cannot ask/request us to cancel the order within this period
if we have already processed the same. |
| Any delivery date given or implied is an estimate only. We do
not guarantee to deliver by a specific date but if we have not delivered the
product within 28 days of acceptance of order you may cancel the order and all
money paid will be refunded. |
| You agree that we shall not be liable to you for any losses,
damages or charges incurred by you because of late delivery of the goods. But if
we are not able to deliver the goods within 28 days of acceptance of order you
may cancel the order and all money paid will be refunded. |
| Even though we aim to dispatch orders within 2 working days,
this may not be possible for complex prescriptions. Our ophthalmologists will
decide whether a prescription is complex or not. Their decision will be final
and binding. The maximum time required for delivering a complex prescription is
28 days. |

7. Inspection |
| You agree to inspect the goods upon delivery and to notify us
immediately by sending an email to returns@Spec2vision.co.uk should they be in
any way defective or inconsistent with your order. In any such event you must
not use the product. |
| The Goods will contain written confirmation of the
prescription of the Goods. If the prescription stated does not match the
prescription you set out in your Order, do not use the Goods or any items
accompanying the Goods and please contact us by telephone or email and inform us
of the problem. |
| If the Goods are defective on delivery, Spec2vision shall at
its absolute discretion repair or replace such Goods or give a refund. |
| If Spec2vision decides to get the goods repaired, then we
will bear the cost of postage and packaging and delivery. |

8. Payment
Information |
| We accept payment by Visa/MasterCard/Delta/AmericanExpress or
any other credit card identified on our site that may be accepted by us from
time to time. |
| All credit and charge card payments are subject to validation
and authorisation by the card issuer. If your card issuer refuses to authorise
payment, we will not be liable for any non-delivery or delay. |
| If there is a problem you are facing in making payments or if
your credit or debit card sign is not available on our website then you can
contact our customer care at ask@spec2vision.co.uk . |

| 9. Return and Refunds and
Guarantee |
| We at Spec2vision give special attention to the quality of
our goods and also we have a unique Query page in which we interact with our
customers and guide them in choosing the product; hence the event of
dissatisfaction with the product is almost reduced to nil. However, we want you
to be totally satisfied with the goods you buy from our site and if you are not
happy with the goods you have purchased, you may return them within 21 days to
us (The 21 day period starts from the date of your order). |
| All the lenses are made to your prescription and the
prescription is checked with you before placing an order. |
| In the event of cancellation you shall promptly return the
Goods, and any items accompanying the Goods to Spec2vision, subject to such
Goods and items being returned in substantially the same condition as when
received by you, we will reimburse you within thirty (30) days of the day
returned Goods and items are received by us. We shall only refund the frame cost
unless until we make a mistake and the lenses are not made to the prescription
submitted by you, in that case we will also refund the lenses cost. Postage and
Packaging cost will not be refunded. |
| The risk of damage to any goods you return to us will remain
with you until the goods have been delivered to our premises and accepted by us
at those premises. |
| Also no monies will be refunded if (a) the goods are
not in the “as new” condition (b) all the items sent with the goods are not
returned, (c) we have not received the payment in full for the goods. |
| Spec2vision may not replace any Goods or give a refund if (i)
it has not received the defective Goods back from you or (ii) if the defect is
caused by misuse or mistreatment of the Goods (that decision will be again on
the sole discretion of Spec2vision). |
| In the event of cancellation, risk in the Goods remains with
you until Spec2vision receives the Goods. |

10. Liability |
| Spec2vision does not accept liability for any consequential
or incidental damages as a result of products purchased from or use of this
website and our liability for direct loss is limited to the purchase price of
the product from which any such claim shall arise. |
| Spec2vision shall not be liable for any allergic reaction to
frame or lens materials. All frame materials are indicated and the purchaser
accepts full responsibility for choosing a frame based on this information.

| Spec2vision shall not be liable to you for any loss of
contracts, loss of income or revenue, loss of profits, loss of goodwill or loss
of insurance cover. Also, we are not liable for any consequential or indirect
loss of any kind arising out of or in connection with this Agreement however
caused and whether arising under contract, tort, negligence, misrepresentation
or otherwise. This exclusion shall apply even if Spec2vision has been advised of
the possibility of such loss or damage. |
| Our maximum liability to you in connection with any physical
damage caused to your property through our negligence will not in any
circumstances exceed £100. In all other cases, our total liability whether in
contract, tort and breach of statutory duty or otherwise will not exceed the
price of the goods and services (or £100, whichever is lower) to which the claim
relates. |
| Spec2vision shall not be liable to you where the loss or
damage results from information provided by you that is inaccurate, false or
misleading or that otherwise results from a breach by you of these Terms and
Conditions. |

11. General |
| These terms and conditions shall be governed by English Law.
|
| These terms and conditions are subject to change at any time
without prior notice to you. |
| Notices served under these terms and conditions shall be in
writing and will be deemed given when: (1) personally delivered; or (2) when
sent by confirmed fax; or (3) three days after being sent by registered mail to
the address set out in our despatch note, or to any other later
address. |
| We reserve the right to amend prices and specifications
without notice. |
| We can only supply lenses to a valid prescription that is
less than two years old and we reserve the right to ask for a copy of that
prescription. |
| We cannot supply lenses to those who are under 16 or
registered partially sighted. |
| A binding contract is only entered into when we accept your
order. |
| Goods remain the property of Spec2vision unless until the
payment for the goods is made in full. |
| Unless you state otherwise, we use an appropriate average
pupillary distance 'PD' to complete your order. Qualified dispensing opticians
have provided this PD measurement. By agreeing to these terms and conditions,
and unless you state otherwise, you will be agreeing to let us use an average PD
of 60mm for single vision reading, distance and bifocal lenses. Spec2vision
strongly recommend that you consult your optician to obtain your PD before
ordering, and provide that number to us when ordering. |
| You will be liable for any loss or damage to the goods from
the time of delivery unless such loss or damage is caused by our
negligence. |
| The contract to purchases the goods from Spec2vision is
personal to you. Nobody other than you will be able to benefit from this
contract. You may not transfer your rights or the benefit of any of the
provisions of this contract to any other person without our prior written
permission. |
| We may assign or subcontract the contract or any part of the
contract to any person, firm or company. |

12. Promotional Offers and Gift Vouchers
|
| Promotional Offers and Gift Vouchers are valid for all the
customers who are aged 16 and over and who purchases goods from Spec2vision
website. |
| A coupon entitles a customer to get a discount on the
specified products and gift vouchers entitles a consumers for gifts. |
| Both, coupons and Gift vouchers are not redeemable for
cash |
| Both, Coupons and Gift vouchers can be used in conjunction
with the products purchased and not alone, unless explicitly
specified. |
| All promotional items or goods are subject to availability
and no cash or other alternatives shall be available. Coupon redemption and
promotional offers may be subject to a time limit specified on said coupon or on
the Spec2vision website. We may extend any coupon offer or promotion at our
absolute discretion. |
| We reserve the right, at our absolute discretion, to withdraw
or vary all coupons and promotional offers due to unforeseen circumstances. Any
withdrawal or notification of the offer will be notified in these terms and
conditions. |
| Accepting the money off at point of purchase constitutes
acceptance of these conditions. |
| Coupons and promotions may be void where prohibited by
law. |

13. Amendments / Cancellation to an
order |
| At Spec2vision, goods are made to your prescription and they
are highly personalised, so you may be charged for any changes made in the
product order before the dispatch. The charge will be for the time and materials
used in the preparation of the order. |
| Also, any orders cancelled before the dispatch will also have
to pay charges for the time and materials used in the preparation of the
order. |
| The site will not refund any monies if the order is cancelled
after the goods are been dispatched. |
| You accept responsibility for entering your prescription
details and providing a 'PD' measurement. |

14. Things beyond
control |
| Spec2vision shall not be liable for failure to comply with
these Terms and Conditions owing to any act or event beyond its control
including but not limited to natural disasters, Acts of God, riots, civil
commotion, strikes, shortage of supplies, lock-outs, industrial action, war,
disease or fire. |

15. Postage and
Packaging |
| Postage and packaging charges may be added in addition to the
price of the goods. Before completing an order, a summary of charges is
displayed and the charges for Postage and packaging (if any) will be
mentioned. |
| Our packaging is designed to fit through an average size
letterbox but it is your responsibility to ensure that goods can be physically
delivered to the address supplied. |

| 16. Our Personal
Data |
| We will ensure that our employees, agents and subcontractors
shall, at all times, comply with the provisions of the Data Protection Act 1998
in relation to data received from you in relation to this contract and shall
only process personal data received from you where necessary to fulfil our
obligations under this contract. |

17. Use of Cookies |
| A cookie is a text-only string of information that a website
transfers to the cookie file of the browser on your computer's hard disk so that
the website can remember who you are. A cookie will typically contain the name
of the domain from which the cookie has come, the "lifetime" of the cookie, and
